The Competition Commission of Pakistan (CCP) will hold an open public hearing on August 27 to examine misleading marketing practices and broader competition concerns in Pakistan’s real estate sector, with particular focus on false claims, hidden charges and inaccurate representations regarding project approvals.
The hearing comes amid complaints received by the competition regulator concerning deceptive and potentially anti-competitive practices in the property market, where buyers and investors can commit substantial amounts of money on the basis of information provided by developers, builders, marketing companies and other market participants.
The CCP has invited consumers, property buyers, investors, developers, builders, real estate professionals, industry associations and other stakeholders to participate in the proceedings and share their experiences, concerns and recommendations directly with the regulator.
According to the commission, information relating to a real estate project’s approvals, features, facilities, charges and other material details can significantly influence a consumer’s investment decision. Misrepresentation or concealment of such information can therefore expose buyers and investors to serious financial consequences.
One of the key issues expected to come under scrutiny is the marketing of projects on the basis of inaccurate or misleading claims regarding regulatory approvals. The hearing will also provide stakeholders with an opportunity to raise concerns over undisclosed or hidden charges, misleading descriptions of project features and other marketing practices that may affect fair competition and consumer interests.
The commission has highlighted that deceptive marketing is prohibited under Section 10 of the Competition Act, 2010. The provision covers the dissemination of false or misleading information where such representations are capable of harming consumers or the business interests of competing companies.
The CCP has previously conducted inquiries, initiated enforcement proceedings and issued orders in cases involving deceptive marketing practices in the real estate sector. However, the regulator believes that wider engagement with market participants is necessary to develop a more comprehensive understanding of problems affecting the sector.
The upcoming hearing is therefore expected to go beyond individual complaints and examine broader market practices from both consumer and business perspectives.
Through direct engagement with buyers, investors, developers and industry professionals, the commission aims to identify practices that may distort competition, mislead consumers or create an unfair advantage for certain market participants.
The public hearing will be conducted under Section 29(c) of the Competition Act, 2010, which empowers the CCP to hold open hearings on matters affecting competition in the country.
Information, complaints and recommendations presented during the proceedings will be formally recorded and considered by the commission while developing its opinion and recommendations on competition and marketing practices in the real estate sector.
The initiative could have significant implications for Pakistan’s property market, particularly as advertising and marketing play a major role in the sale of housing schemes, apartments, commercial developments and other real estate projects. Greater scrutiny of approval claims, pricing disclosures and project representations could strengthen transparency and help investors make better-informed decisions.
The hearing will be held from 4:00 pm to 6:00 pm on August 27 at the Competition Commission of Pakistan office, ISE Towers, Jinnah Avenue, Islamabad.
Participation requires prior registration, and stakeholders wishing to attend or present their concerns must register by August 25.
