Islamabad | ReNews Pakistan
The Islamabad High Court (IHC) has sought a detailed explanation from the federal government and relevant authorities over the apparent failure to effectively enforce fire safety laws in the capital, questioning whether buildings are being allowed to operate without mandatory fire safety clearances.
Chief Justice Sardar Mohammad Sarfaraz Dogar directed the federation and other respondents to submit a detailed report and para-wise comments within two weeks on a petition seeking a comprehensive fire safety audit of buildings across Islamabad. The petitioner has also requested the sealing of buildings operating without the required fire safety no-objection certificates (NOCs).
The case has gained importance following the August 26 fire at the Pakistan Institute of Medical Sciences (PIMS), in which several newborn babies lost their lives. The petitioner argued that the incident exposed serious weaknesses in the implementation of fire prevention and life safety regulations in the federal capital.
The petition questioned why commercial, residential, educational and medical buildings continue to operate despite alleged deficiencies in firefighting equipment, emergency exits and mandatory fire safety NOCs.
The petitioner invoked the Islamabad Fire Prevention and Life Safety Regulations 2010, which provide authorities with powers to inspect buildings, identify violations, order corrective measures and take action against premises that fail to meet prescribed safety standards.
Under the regulations, the Director of Emergency and Disaster Management can order the evacuation of a building declared dangerous. In cases of non-compliance, occupants can be removed with police assistance and the building can subsequently be sealed in the presence of a magistrate.
The petitioner asked the court to order a citywide audit rather than limiting the exercise to an inquiry into the PIMS fire. He sought identification and public disclosure of buildings operating without valid fire safety NOCs and requested that non-compliant premises be sealed until they meet the required standards.
The petition further proposed linking the registration of hospitals and educational institutions with valid fire safety NOCs, stressing that such facilities cater to vulnerable populations and must have basic life-saving arrangements.
It was also argued that fire safety clearance is required at different stages of a building’s lifecycle, including plan approval and completion certification, while existing buildings are also required to adopt prescribed safety measures.
During the hearing, petitioner Munir Ahmed’s counsel, Advocate Azhar Siddique, told the court that the issue had previously been examined by the National Assembly’s Standing Committee on Health. He said the committee had communicated with the prime minister and National Assembly speaker regarding PIMS, but its recommendations did not appear to have resulted in effective action.
The court clubbed the petition with another case concerning a judicial inquiry into the PIMS fire tragedy. Chief Justice Dogar observed that an earlier order had already been passed on a similar petition and that the relief sought in the present case was substantially the same.
The Chief Justice directed that the cases be consolidated and observed that the Attorney General should examine the matter. The federal government has been asked to provide details of action taken on the previous standing committee report along with its para wise comments within two weeks.
