The Senate Functional Committee on Devolution has directed the Petroleum Division to develop a practical mechanism for ensuring joint and equal control of oil and natural gas resources by the federal government and provinces, setting a 15-day deadline for the submission of a comprehensive implementation report.
The committee proposed that provinces should either receive 50 per cent of the profits generated by oil and gas companies or be granted control over half of the oil and gas wellheads to secure their constitutional share in the country's natural resources.
Chaired by Senator Zamir Hussain Ghumro, the meeting examined the implementation of Article 172(3) of the Constitution, joint ownership of natural resources and provincial representation in federal institutions.
Members expressed concern that, despite 16 years having passed since the adoption of the 18th Constitutional Amendment, an effective framework for joint management of oil and gas resources and equitable distribution of revenues between the federation and provinces had yet to be fully established.
The committee observed that delays in implementing the constitutional provisions had prevented the development of a comprehensive system through which provinces could exercise their ownership rights and participate effectively in the management of natural resources.
Article 172(3) of the Constitution provides that mineral oil and natural gas within a province shall vest jointly and equally in that province and the federal government. The committee stressed that this constitutional requirement must be supported by clearly defined administrative and financial arrangements.
Members voiced dissatisfaction with repeated procedural delays by the Petroleum Division. They observed that continuously referring devolved matters to the Council of Common Interests (CCI), without achieving tangible progress, undermined the intent of the constitutional amendment.
Senator Ghumro directed the Petroleum Division to consult relevant provincial authorities and stakeholders and prepare a clear, actionable mechanism for implementing Article 172(3).
The Petroleum Division was instructed to submit a detailed report within 15 days, outlining arrangements for joint and equal federal-provincial control over natural gas and petroleum resources.
The committee also examined provincial representation in federal services under Article 38(g) of the Constitution, covering recruitment and promotions from Basic Pay Scale (BPS) 1 to 22, as well as positions in public corporations, statutory bodies and autonomous institutions.
Members noted the absence of an effective mechanism to ensure provincial representation in recruitment and promotions, particularly at senior administrative levels. The chairman highlighted disparities in provincial representation across 38 federal government divisions, with particular concern over Balochistan's limited presence in senior positions.
Compliance reports submitted by federal divisions and the Federal Public Service Commission (FPSC), following directives from the Establishment Division, were also reviewed. The committee expressed concern over the absence of FPSC representatives, given the commission's direct responsibility for federal recruitment processes.
The secretary of the Establishment Division assured the committee that the relevant constitutional provisions would be implemented. He clarified that employees receiving salaries from the federal government fell within the scope of the applicable provincial quota arrangements.
He further stated that provincial shares, particularly Balochistan's allocation, would be calculated and measures taken to fill the required positions in accordance with the prescribed quotas.
The meeting also discussed the scale of federal expenditure. Senator Ghumro stated that federal spending stood at approximately Rs19 trillion against total national tax and non tax revenues of around Rs20 trillion. He called for a substantial reduction in federal expenditure to improve fiscal management.
The committee's deliberations underscored the need for stronger institutional arrangements to implement constitutional guarantees concerning natural resource ownership, revenue sharing and provincial representation in federal institutions.
The proposed mechanism for oil and gas resources is intended to translate the constitutional principle of joint ownership into practical administrative and financial arrangements, with the Petroleum Division expected to present its implementation plan within the stipulated period.
